Having a Will prepared is a very important aspect of Estate Planning. In order to assure that your loved ones are taken care of after you pass away, it is important to have your wishes put into a Will. A Will not only delegates who you would like your Executor to be or who you wish to benefit from your Estate, it can also help avoid costly estate(s) administration fees.
Having a Power of Attorney for Personal Care is very important. This Power of Attorney will allow a specific person, with whom you choose, to make decisions in regards to your personal care, when you are unable to make those decisions for yourself. It will also make it easier for the person, whom you choose, to obtain pertinent information regarding your health from doctors and nurses.
Having a Power of Attorney for Finances is also very important. This Power of Attorney will allow a specific person, whom you choose, to make decisions, on your behalf, regarding your finances, should you become unable to manage your finances. Estate Administration
Administering an Estate can be very time-consuming for an Executor. A few of the duties of an Executor may include:
o Making funeral arrangements;
o Locating the Original Will (if applicable);
o Obtaining a Death Certificate;
o Cancelling accounts of the deceased (ie. cable, telephone, internet, etc);
o Establishing the value of all assets;
o Locating all beneficiares;
o Confirming if probate is necessary; and
o Completing the final income taxes of the deceased.
The above is just a short list of the duties that an Executor may need to perform. Our office will provide you with the guidance you need when you arrive for your initial appointment. *Please bring the original Will and an original signed copy of the deceased's Death Certificate, along with any other information that you feel may be applicable.
